Allahabad High Court’s Lucknow bench orders FIR against Rahul Gandhi in dual citizenship case.

Lucknow, India — April 18, 2026

The Lucknow bench of the Allahabad High Court has ordered the registration of a First Information Report (FIR) against Congress leader and Leader of Opposition Rahul Gandhi in connection with allegations of dual citizenship.

The court directed that the matter be investigated either by the Uttar Pradesh government or a central agency, emphasizing the need for a thorough examination of the claims. The order was passed on Friday, escalating legal scrutiny in a case that has been under consideration for an extended period.

Court Directs Probe Into Allegations

According to government counsel V.K. Singh, the bench led by Justice Subhash Vidyarthi instructed the state authorities to either conduct the investigation themselves or refer it to a central investigative agency.

The directive came in response to a petition filed by BJP worker S. Vignesh Shishir from Karnataka, who alleged that Rahul Gandhi may possess citizenship of both India and the United Kingdom, potentially violating Indian law.

Background of the Case

The petitioner claimed that Rahul Gandhi could be holding passports from two countries, which would contravene provisions under Indian citizenship laws.

Earlier, on January 28, a special MP/MLA court in Lucknow had dismissed Shishir’s plea seeking registration of an FIR against Gandhi. The lower court had stated that it lacked jurisdiction to adjudicate on matters related to citizenship.

Challenging that decision, the petitioner approached the High Court, leading to the current order directing the filing of an FIR and further investigation.

Legal Provisions Cited in Petition

The petition invokes multiple legal provisions, including:

  • Indian Penal Code equivalent under Bharatiya Nyaya Sanhita (BNS) 2023
  • Official Secrets Act, 1923
  • Passport Act, 1967
  • Foreigners Act, 1946

The petitioner argued that the issue extends beyond citizenship and may involve broader legal and national security concerns.

Centre Asked to Provide Records

During earlier hearings, the High Court had sought clarification from the central government regarding any action taken on complaints related to Gandhi’s alleged British citizenship.

The court had also requested submission of relevant records pertaining to the matter, indicating the seriousness with which the allegations are being examined.

What Happens Next

With the court now ordering the registration of an FIR, the investigation process is set to begin. Authorities will examine documents, records, and evidence to determine the validity of the allegations.

Legal experts note that the case could take time as it involves verification of international records and compliance with multiple legal frameworks.
