The Ministry of Home Affairs (MHA) has issued a notification under the Immigration and Foreigners Rules, 2026, introducing stricter compliance requirements aimed at improving immigration oversight, strengthening national security, and maintaining accurate records of foreign residents across the country.
Under the revised regulations, foreign nationals can no longer wait until after completing 180 days in India to begin the registration process. Instead, those planning to extend their stay beyond the permitted period must complete registration before the 180-day limit expires.
New Registration Requirement for Foreign Visitors
According to the notification published in the Official Gazette, any foreign national entering India on a visa valid for 180 days or less must register with the designated authorities if they intend to remain in the country beyond that period.
The new rule is designed to ensure that immigration authorities receive updated information about long-term foreign residents before their authorized stay exceeds the initial visa duration.
Government officials say the move will improve administrative efficiency and help authorities maintain accurate immigration records.
What Has Changed From the Previous Rule?
The latest provisions replace the earlier framework that allowed foreign nationals to register within 14 days after completing 180 days in India.
Under the previous system, visitors were granted a grace period after crossing the six-month threshold. That provision has now been removed under India Foreigner Registration Rules 2026.
As a result, eligible foreign nationals must now complete registration procedures in advance rather than after the permitted stay period has been exceeded.
Long-Term Visa Holders Also Covered
The revised rules are not limited to travelers entering India on short-duration visas.
Foreign nationals holding visas valid for more than 180 days may also be required to register if their stay exceeds prescribed limits during a single visit or cumulatively within a calendar year.
The government has emphasized that compliance with registration requirements will be mandatory for all affected visa categories.
Relief for Children Born in India to Foreign Parents
While the government has tightened registration procedures for foreign nationals, the notification also introduces certain relaxations for children born in India to foreign parents.
Previous Requirement
Under earlier regulations, parents were required to notify registration authorities online within 30 days of a child’s birth. This notification was necessary for obtaining a visa, registration status, or exit permit for the child.
New Relaxation
The updated rules provide relief in cases where one parent is an Indian citizen and wishes to retain Indian citizenship for the child.
In such situations, the earlier mandatory reporting requirement related to visa and exit permit procedures will no longer apply.
Citizenship Change Must Still Be Reported
However, if the child later acquires citizenship of another country while residing in India, parents must notify the registration authority within 30 days of the change.
Officials say this provision will help ensure that nationality records remain accurate and up to date.
Hospitals and Nursing Homes Face Stricter Compliance Requirements
The notification also introduces stronger reporting obligations for hospitals, nursing homes, and other healthcare institutions across India.
Medical facilities that accommodate or provide treatment to foreign nationals will be required to maintain detailed records and comply with updated administrative procedures.
The government believes these measures will improve coordination between healthcare institutions and immigration authorities while enhancing transparency.
