Supreme Court on CBI Probe Limits : In a landmark ruling, the Supreme Court of India clarified that ordering a CBI investigation should be considered only as a last resort, and not as a routine response to public complaints or petitions.
Delivering the judgment, the Chief Justice stated, “While the CBI is a capable investigative agency, its intervention must not undermine the authority of state police forces. Judicial oversight is essential, but routine transfers of investigations to the CBI risk unnecessary delays and administrative burdens.”
This ruling comes after a spate of petitions where the central investigative agency was repeatedly called in for politically sensitive cases. Legal experts see this judgment as a reinforcement of judicial prudence, balancing the need for impartial investigation with state sovereignty.
Former Solicitor General A. K. Mehta commented, “The Supreme Court has rightly emphasized that the power to order a CBI probe is extraordinary. It must be exercised with caution, ensuring it is not misused for publicity or political leverage.”
The ruling also suggests that courts should provide clear reasons when directing cases to the CBI, specifying whether local police inadequacy or complexity of the case warrants central intervention.
