National Herald Case: Congress Says ‘Truth Has Prevailed’ After Court Rejects ED Chargesheet

The Rouse Avenue Court in Delhi on Tuesday granted major relief to the Gandhi family in the National Herald case, refusing to take cognizance of the chargesheet filed by the Enforcement Directorate (ED). The court, however, clarified that Rahul Gandhi, Sonia Gandhi, and other accused are not entitled to copies of an FIR, as the ED’s case is not based on any registered police complaint.

Following the court’s order, the Congress party strongly welcomed the decision, calling it a victory of truth and an exposure of what it described as the Modi government’s politically motivated actions.

Congress Reacts: ‘Truth Has Prevailed’

In a post on its official X (formerly Twitter) handle, the Congress said, “Truth has prevailed.” The party alleged that the Modi government’s intent and unlawful actions have been fully exposed by the court’s ruling.

The Congress further claimed that the court found the ED’s action against Sonia Gandhi and Rahul Gandhi in the Young Indian case to be illegal and driven by malice. According to the party, the court observed that the ED lacked jurisdiction and that no money laundering case could exist without a valid FIR, making the agency’s action legally unsustainable at this stage.

The party accused the ruling government of pursuing political vendetta against the principal opposition party for over a decade, stating that allegations of money laundering, proceeds of crime, and asset transfer had collapsed in court. Reiterating its resolve, the Congress said it would continue to fight for truth and the constitutional rights of every Indian, concluding its statement with “Satyameva Jayate.”

‘Truth May Be Troubled, But Not Defeated’: Sukhdev Bhagat

Reacting to the court order, Congress leader Sukhdev Bhagat said the ruling reaffirmed a long-held belief that “truth may be troubled, but it can never be defeated.” Calling the decision welcome, he described it as a clear victory for truth, once again invoking the phrase “Satyameva Jayate.”

ED Allowed to Continue Probe

While declining to take cognizance of the chargesheet, the court clarified that the Enforcement Directorate is free to continue its investigation in the National Herald money laundering case. However, it emphasized that no further legal proceedings can be initiated at this stage, as the ED’s case is not based on an FIR but solely on a private complaint filed by BJP leader Subramanian Swamy and related magisterial summons.

The ruling is being viewed as a procedural setback for the ED and a significant political relief for the Congress leadership, even as the investigation technically remains open.
